Understanding OH&S Jurisdictions in Canada

Occupational Health & Safety legislation in Canada is divided into 14 jurisdictions:

  • 1 federal

  • 10 provincial

  • 3 territorial

Federal OH&S (Canada Labour Code Part II)

The federal code applies to workers in industries that operate across provincial or international borders, including:

  • Airports

  • Railways

  • Pipelines

  • Interprovincial trucking

  • Shipping & marine transport

  • Radio, TV, and telecommunications

  • Banks

  • Federal government departments

  • Grain elevators & certain grain-processing facilities

  • Oil & gas exploration on federal lands

Approximately 10% of Canadian workers fall under federal OH&S legislation.

The remaining 90% of workplaces must comply with their respective provincial or territorial OH&S laws.
